The protection of your personal data is of particular concern to EL-LEGAL. EL-LEGAL is the data controller within the meaning of this data protection declaration and within the meaning of the data processing operations within the meaning of the DSGVO; it processes your data exclusively on the basis of the statutory provisions and constantly strives to keep its data protection provisions up to date and to handle your data responsibly at all times.

Data collection, legal basis, purpose of use of the data

EL-LEGAL processes your data in accordance with the relevant provisions of data protection law, in particular those of Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data (European Data Protection Regulation - DSGVO), the Federal Act on the Protection of Personal Data as amended by Federal Law Gazette I No. 120/2017 (Data Protection Act 2000 - DSG 2000) or. of the Data Protection Amendment Act 2018 BGBl. I No. 120/2017 and the Data Protection Deregulation Act 2018 for the purpose of (i) exercising its business purpose and all associated business activities or necessary administrative activities, (ii) making offers, drafting contracts and executing contracts and/or (iii) for the purpose of contacting you as requested and communicating with you further.

In addition to the above-mentioned purposes, EL-LEGAL may also process your personal data for the purpose of direct advertising within the scope of its legitimate interest pursuant to Article 47 of the GDPR with regard to the improvement of the offer and web presence of EL-LEGAL; this includes, in particular, the sending of information and offers on further products and services for marketing and advertising purposes by post/e-mail/telephone.

Recipients, data transfer to third countries

Within the company of EL-LEGAL, those employees shall have access to the personal data provided who require such data for or in the performance of their duties within the scope of the purposes stated above. The data may be disclosed or transmitted to the data processors as well as to affiliated companies of EL-LEGAL and processed there for the aforementioned purposes as well. A written order processing agreement shall be concluded with the appointed order processors (service providers), whereby the order processors shall be obliged to comply with all contractual and legal obligations incumbent upon EL-LEGAL and thus, if applicable, also to maintain secrecy and confidentiality.

Data transfer to countries outside the EU or the EEA (so-called third countries) may take place if there is a legal basis for this as mentioned above.

Storage period

Personal data is processed and stored - to the extent necessary - for ongoing communication, follow-up questions, internal communication and administration, for the duration of the consent or for the duration of any contractual relationship/business relationship resulting therefrom, as well as beyond that in accordance with the statutory retention and documentation obligations resulting from the relevant provisions, in particular from the Austrian Civil Code (ABGB), the Austrian Commercial Code (UGB), the Austrian Federal Fiscal Code (BAO). In particular, the storage periods of up to 30 or 40 years resulting from the ABGB in certain cases must be taken into account. The data is deleted as soon as it is no longer required for the purpose of its processing and there is no longer a legal obligation to store it.

Rights as a data subject, complaint to the supervisory authority

You have the right to object at any time and without giving reasons to the processing of personal data concerning you which is carried out on the basis of the legitimate interests of EL-LEGAL pursuant to Art 6 (1) lit f DSGVO, insofar as the law grants you this possibility.

If you have given your consent, you have the right to revoke it at any time and without giving reasons.

In addition, you have the right to information about your stored personal data at any time, as well as the right to correction, deletion (or restriction of processing) of your stored personal data, as well as a right to data transfer (in particular pursuant to Art 7 para 3, 15, 16, 17, 18, 20, 21 DSGVO).

Please send your objection (revocation, if applicable), as well as your request for information, deletion (or restriction) and/or data portability to office@el-legal.com. Regarding data portability, please note that in the latter case, this request can only be complied with if it does not involve a disproportionate effort.

Violations in connection with the processing of personal data against the applicable data protection law or violations of data protection claims in any other way can be reported to the competent supervisory authority by filing a complaint. The competent authority in Austria is the Austrian Data Protection Authority, Wickenburggasse 8, 1080 Vienna.
